Comfort Plans Terms
Pioneer Plumbing and Heating Inc. Membership Agreement General Terms and Conditions:
- DEFINITIONS: "Authorized Service Technician" means any individual or entity subcontractors authorized to service in-home systems and equipment that have been selected for parts by the Service Experts. "Customer" means the individual purchasing the service. "Plan" is the type of "Service" membership the Customer has contracted. "Equipment" is the subject of the "Service" maintenance. "Use" is the proper and intended utilization of the "Equipment" under this agreement with the heading "Introduction: New Membership" also set out on the document with the heading "Sample/Welcome". "Membership" is the process and conditions of your Service Plan which is hereby incorporated into these Terms and Conditions. "Service Plan" means the specific service plan selected by You on the Membership details, which are mailed with service plans and conditions, and the free part, details of Service requests installation, inspection, servicing, or repairing steps, "Guide" means the method, or function of Equipment. "Conditions" a situation or aspect of something as required or imposed as terms and conditions. The Membership Guide, "Service Experts" in this "Terms" or "Manual" and "Terms LLC a Delaware limited liability company and us and its subsidiaries and affiliates. "Guide" means the operating terms and conditions Service Experts Membership Conditions.
- SERVICE PLAN TERMS & PAYMENT: Your Service Plan remains in effect for as first period of one year, from "Coverage Start Date" and coverage starts 10 days after you enroll in the Service Plan with Pioneer Plumbing and Heating Inc. When you renew, there is an automatic renewal process, unless your Authorization to renew ceases or the anniversary of your Coverage Date for Your New Year term, which You have given us notice to you (hereafter "Date"). Your Annual Plan may not survive Service Plan or opt-out renewal. Your Service Plan term "Service" is 1 Year terms; your payments will be Payment Annual lump sum payment for 10 years with Monthly Payment Plan without any agreement.
- SERVICE PLAN CANCELLATION: You have cancellation rights within 10 days, and if no services have been rendered, as part of the Service Payments, your Annual Term of Service will be voided. You will earn a full refund of payments made within 10 days, and if You cancel within the 10 days. Your Plan will be canceled, mailed as voided refundable. You will be entitled to the lesser of the refund value, or the full sum, if You cancel the Service Plan and failing to pay any installments or Your Plan. If Your Plan will be rescinded to be entitled to a refund of your Service Plan payment, Cancellation Fee You will be issued any part of your installments voiding your contract. Service Plan issued refund not met original guidelines we could issue to you a proportional share of any remaining term of Service Plan. The termination or cancel your Service Plan at any time, for any reason, including your dissatisfaction, except as otherwise stated in these Terms and Conditions. We may cancel the Service Plan for violations of this membership agreement.
- SERVICE PLAN MODIFICATIONS: We may modify your Pioneer Plumbing and Heating Inc. Membership Plan, including but not limited to the coverage under your Anniversary Date, changes in pricing, with a 30-day advance notice to you.
- LIABILITY/ NO WARRANTIES: THE PIONEER PLUMBING AND HEATING INC. MEMBERSHIP PLAN, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE OTHERWISE AS IN THE CONTRACT, ITS AGENTS, AGENTS OR EMPLOYEES, OR OTHERWISE LIABLE FOR SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, LOSS OF INCOME, LOSS OF USE FROM THE BREAK-DOWN OR FAILURE OF ANY EQUIPMENT UNDER OPERATING FROM LOSS OF, OR REDUCTION IN USE OF, EQUIPMENT, LOSS OF DATA RESULTING FROM THE OPERATION, FAILURE OF REPLACEMENT PRODUCTS RESULTING FROM THE BREAKDOWN, EXPENSE OR INCONVENIENCE FROM THE OPERATION OR MAINTENANCE OR ANY OTHER ADJUSTMENT OR EXPENSES RELATING TO THE COVERED EQUIPMENT. NEW INSTALLATION OR INSTALLATION OF THE REPLACEMENT, NO LOSS, COSTS OR DAMAGE ARISING FROM ANY SERVICE(S) PROVIDED BY PIONEER PLUMBING AND HEATING INC. ARE RESPONSIBLE FOR, LIABLE FOR ANY GRIEVANCES OR LOSSES. THE PRICE PAID BY CUSTOMER FOR THE SERVICE MEMBERSHIP, EXCEEDS THE COST OF DAMAGE OR LOSS.
- WARRANTY: WE MAKE NO REPRESENTATIONS OR WARRANTIES as to the parts and labor, products for the risk, loss, or liabilities. During the manufacturer's warranty period, the manufacturer is responsible for fixing. We understand their user guides and warranties, subject to the limitations set out under "Liability". We will repair or replace Components. Subject to you carrying out your obligations under these Terms and Conditions, and if covered by the manufacturer's warranties and covered by our Service Plan and if your Service Plan lapses, we will warranty our parts and labor for 90 days after the expiry or the guarantee is not a manufacturer's, the supplier or We are making any warranty or repair. We are not part of the parts of design or manufacturing. Add the warranties guaranteed by product, the applicable labor and the necessary extent to the extent of problems incurred.
- SERVICE PLAN EXCLUSIONS: This Service Plan does not cover: (1) any additional equipment that is not defined as Equipment hereunder, unless Service Experts agrees to cover same, which agreement they may obtain an additional fee. This may optionally bill based on the nature of the request; (2) any maintenance or Equipment that has been altered or repaired by anyone else than an Authorized Service Technician, including any unauthorized alterations made by or on behalf of You to the Equipment; (3) damage or other equipment failure due to any cause before Service Expert Inc.'s initial intake of the Equipment; (4) any incidental or consequential damages, including but not limited to the Equipment according to the Operator negligence, Customer's failure to maintain the Equipment according to the Operator negligence, Customer's failure to maintain the Equipment according to the manufacturer's instructions, abuse, vandalism, theft, fire, flood, wind, freezing, power failure, inadequate power supply, unusual atmospheric conditions, acts of war, acts of God, or acts of nature, acts of nature, including but not limited to storms, earthquakes, or water damage (frost, freeze, flood, rain, overflow, etc.), accidental or consequential damages caused by any of the foregoing, including but not limited to mold, mildew, bacteria, any substance, toxicity, asbestos material, harmful materials, batteries (except those required by program), external to an air conditioning refrigeration lines, ordinary light wear to parts, lack of maintenance, or any failure or damage not caused by normal use of the Equipment; (5) tuning and calibration of equipment unless explicitly included in the scope of the applicable Service Plan; (6) any malfunctions, failures, or types of repair that are expressly specified in the manufacturer's warranty, the operation of the parts, unless and only protected by such as and if applicable, such as coils, drums, exhaust fans, external controls, or the malfunction of the defect; (7) any unauthorized alteration, modifications or additions made to or affecting the Equipment, such as built-in controls, frames or wall framing, roof or attic installation(s), installation(s), reconstruction, improper maintenance, unauthorized manual(s), external controls, valves, compensator trimming device and repair of hose seepage; and/or other repairs, maintenance or refrigeration; (8) any costs incurred either for fuel or use cases, either indirect energy efficiencies or resulting from the design of the specialized contractor(s), all questions specifically related to contractors that are to be directed at said contractor(s). These issues should be reported to the contractor directly. Additionally, all equipment or equipment such as jacks and labor relating to the installation of the Equipment in an appropriate manner and the storage and use of such PIONEER PLUMBING AND HEATING INC. Service Plan warranty.
- SERVICE PLAN REPORT: Before the Service Plan term begins, a report by a Monthly Investment by Pioneer Plumbing and Heating Inc., as indicated by the Member Agreement, must be established. Any results approved under this Membership will not in the first 90 days of the Membership, be subject to any charges that are added to your initial payment. Any charges (including GST) will be added on any installment when billed. Your Service Plan includes term service provided, monthly bill, etc. Most of our laboratory testing may be introduced at your expense. We charge to bill exceptionally during the payment at the point, billed to set up only the annual payment, billed on any other payable term which they can bill and due on the annual payment in advance. Payment will be charged at the rates made at the time and billing cycle at the bank, paid by direct deposit only. To pay off the balance or schedule auto-payments.
- SERVICE FEE: Pioneer Plumbing and Heating Inc. shall schedule a date for a Service at the time of the Service Plan. A $50 service call-out is a 1-day service to the member to attend the appointment. If any Service is not scheduled at the time of purchase, but if the appointment is cancelled or otherwise prevented from occurring, including non-attendance or payment arrangements or concerns related to any aspects of the customer. Service Experts will permit three (3) reasonable attempts at service before payment is sent to the customer immediately to schedule with them. Service Experts cannot commit to a set time frame as applicable to all services, or is not permitted to arrange Service. The customer there are three (3) responsible attempts to schedule the appointment. Each permit three attempts to schedule the Service, and PIONEER PLUMBING & HEATING INC shall fulfill all obligations associated with the purchase of and service to provide any training and tools to provide the Service successfully.
- CONSENT TO CONTACT & OTHER UNDERSTANDING: Pioneer Plumbing and Heating Inc. and their related entities associated with us. Your expressed consent and shall PIONEER PLUMNBING AND HEATING INC conduct any phone (via voice or text) automated call(s) to you and provide to provide text, email services associated with your purchase or products and service we receive phone, communications and advertising about the Service. You consent to refuse via opt-out at email us. Your consent regarding the Privacy and product, sent information to our third-party partners about the way we made your agreement and conduct on our website to the laws governing handling disputes, which shall be conducted and jurisdiction by forums in CANADA. - WAIVER: Each waiver of any breach by Pioneer Plumbing and Heating Inc. of any provision of this Agreement shall be considered a waiver of any subsequent breach of the same or any other provision. Service Experts' rights and remedies under the Agreement are cumulative and not exclusive of any rights or remedies that would otherwise be available to Pioneer Plumbing and Heating Inc. under the law or any other agreement and shall be in addition to and not in substitution of any other rights and remedies available under any Service Experts service or applicable law.
- CONDITIONS OF SERVICEABILITY: The ongoing and future operation of this Agreement shall be contingent on the health of the parts and systems being maintained to the performance standards that shall be established and amended in the provisions. If a part determines that any part of this Membership Agreement is unenforceable, the court agrees that only the portion of these Terms and Conditions that is found to be unenforceable shall be stricken and that the remaining terms shall be continued to be effective and enforced as intended.
- ENTIRE AGREEMENT: This Membership Agreement and any applicable later statement shall prevail over unilaterally determined changes by you and are all of the terms and all of the statements, understanding, and agreements whether it is expressed or implied, as regards the service agreement or any technology used and specifically set out herein.
